About This Agreement

These Terms of Service govern your use of the St. Louis Mold Pros website, located at stlouismoldpros.com (the “Platform”). The Platform is owned and operated by Cavallo Media, a digital media company based in the United Kingdom. By accessing or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

Cavallo Media reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform after any changes are posted constitutes your acceptance of the revised Terms. We recommend checking this page periodically.

What St. Louis Mold Pros Is — and Is Not

St. Louis Mold Pros is a digital scheduling and lead generation platform. Its sole purpose is to connect homeowners and property owners in the St. Louis area with independent, licensed mold remediation contractors who can assess and address their needs.

Cavallo Media is not a mold remediation company. Cavallo Media does not hold any mold remediation, contractor, or construction license. Cavallo Media does not employ, supervise, direct, or control the work of any mold remediation contractor. Cavallo Media does not perform, manage, or oversee any physical inspection, testing, assessment, containment, removal, or remediation work of any kind. No employee or representative of Cavallo Media will enter your property or perform any services related to mold remediation.

All physical mold assessment and remediation services are performed exclusively by independent licensed contractors who are not employed by or agents of Cavallo Media.

The Independent Contractor Relationship

The contractors made available through the Platform are independent businesses operating under their own licenses, insurance policies, and professional standards. They are not employees, agents, partners, or joint venturers of Cavallo Media. Cavallo Media has no authority over how any contractor performs its work, what pricing it charges, how it interacts with customers, or what results it delivers.

When a contractor accepts a service request generated through the Platform, any agreement for services is formed directly between you and that contractor. Cavallo Media is not a party to that agreement.

Contractor Verification and Current Service Partner

Cavallo Media takes reasonable steps to verify that contractors made available through the Platform hold active state licenses, carry appropriate general liability and workers’ compensation insurance, and maintain IICRC (Institute of Inspection Cleaning and Restoration Certification) certification or equivalent professional credentials at the time of onboarding. Verification is conducted at onboarding and periodically thereafter, but Cavallo Media does not guarantee that a contractor’s credentials remain current or valid at the time your services are performed. You are encouraged to request proof of current licensure and insurance directly from your contractor before work begins.

St. Louis Mold Pros currently coordinates services through a licensed and insured contractor. Current service partner license: #[PLACEHOLDER]. The use of the word “currently” is intentional and reflects the fact that the contractor relationship is dynamic. Cavallo Media may add, change, or discontinue contractor relationships at any time.

No Guarantee of Availability or Response Time

Cavallo Media does not guarantee that a contractor will be available to respond to your inquiry, available to schedule service within any particular timeframe, or available to complete any project by a deadline you may require. Contractor availability depends on factors outside Cavallo Media’s control, including demand, geographic coverage, and contractor capacity. Time-sensitive situations may require you to contact multiple service providers.

TCPA Consent — Contact Form

The following consent language appears below the submit button on the Platform’s contact form and governs communications initiated through that form:

“By submitting this form, I consent to receive calls, texts, and pre-recorded messages from St. Louis Mold Pros and its current licensed contractor partner at the telephone number I provided, including calls and texts sent using automated dialing technology, for the purpose of responding to my service inquiry. Message and data rates may apply. Consent is not a condition of purchasing any goods or services. I may opt out at any time by replying STOP to any text message or by requesting to be removed from call lists when contacted by phone.”

Your Use of the Platform

You agree to use the Platform only for lawful purposes and only to request legitimate mold remediation services for a property you own or manage, or for which you have authority to arrange services. You agree not to submit false, misleading, or fraudulent service requests. You agree not to attempt to interfere with the Platform’s operation, security, or systems.

Intellectual Property

All content on the Platform — including text, graphics, logos, and design — is owned by or licensed to Cavallo Media and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use Platform content for commercial purposes without Cavallo Media’s express written consent.

Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Cavallo Media makes no warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Cavallo Media makes no warranty regarding the quality, safety, timeliness, legality, or fitness for purpose of any services performed by a contractor.

Limitation of Liability

To the maximum extent permitted by applicable law, Cavallo Media’s total liability to you for any claim arising out of or relating to the Platform or these Terms — whether in contract, tort, statute, or otherwise — is limited to the amount you paid Cavallo Media for platform services in the twelve months preceding the claim. In most cases, where the Platform is provided at no direct charge to the user, this amount will be zero.

Cavallo Media is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from the quality of contractor work, personal injury, property damage, loss of profits, or data loss, even if Cavallo Media has been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Cavallo Media and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses — including reasonable legal fees — arising out of or relating to your use of the Platform, your violation of these Terms, or any disputes between you and a contractor.

Each contractor who accesses the Platform through a contractor agreement with Cavallo Media independently agrees to indemnify and hold Cavallo Media harmless from and against any claims, liabilities, or damages arising out of or related to the contractor’s performance of services, the contractor’s licensing or certification status, or any acts or omissions of the contractor toward any customer.

Dispute Resolution

If you have a dispute with Cavallo Media arising out of or related to these Terms or the Platform, we ask that you first contact us at privacy@cavallo.media and attempt to resolve the matter through good-faith negotiation. We will make reasonable efforts to address your concern within thirty days.

If a dispute cannot be resolved through negotiation, it will be submitted to binding arbitration. Arbitration will be conducted on an individual basis; class arbitration and class action lawsuits are waived to the maximum extent permitted by law. You and Cavallo Media each waive any right to a jury trial.

Governing Law and Jurisdiction

Disputes relating to the performance of mold remediation services arranged through the Platform — including disputes between you and a contractor — shall be governed by the laws of the State of Missouri, United States, and you consent to the jurisdiction of the courts of Missouri for resolution of such disputes.

Disputes relating to the operation of the Platform itself, the obligations of Cavallo Media as Platform operator, or any data-related matters shall be governed by the laws of England and Wales, and any unresolved disputes may be submitted to the courts of England and Wales.

Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and Cavallo Media regarding the Platform and supersede any prior agreements. Cavallo Media’s failure to enforce any provision of these Terms does not constitute a waiver of that provision.
